Terms of Service

The terms that apply when you use LitigationWatch. Please read them carefully.

Effective 6 November 2026

Agreement and appointment

These terms are an agreement between you and LitigationWatch (we, us) for the LitigationWatch website and service (the Service). By creating an account or using the Service you agree to these terms. If you use the Service on behalf of an organisation, you confirm you are authorised to accept these terms for it, and "you" includes that organisation.

You appoint us to search and monitor on your behalf. By adding a company or other entity to your watchlist, you expressly appoint and authorise LitigationWatch to carry out searches of, and ongoing monitoring of, court and tribunal information relating to that entity on your behalf, for as long as the entity remains on your watchlist and your plan is active. We carry out these searches and this monitoring at your direction and for your purposes.

For each entity you add, you confirm that you have a legitimate and lawful purpose for the searches and monitoring, and that you will use the results only for that purpose and in accordance with the law.

The Service

LitigationWatch lets you nominate companies and other entities (your watchlist). Our automated monitoring, including AI agents, reviews court and tribunal information published in Australia each day and notifies you by email when it finds activity that appears to involve an entity on your watchlist (an alert).

You acknowledge that:

  • monitoring is limited to information that courts and tribunals make publicly available. Suppressed, sealed, confidential and unpublished matters are not covered, and courts may publish information late, incompletely or not at all;
  • matching depends on the names you provide. You should enter each entity's full legal name and add related entities you want monitored;
  • alerts are produced by automated systems and may contain errors, may miss matters, or may match a different entity with a similar name; and
  • you must check the relevant court record before relying on any alert.

No legal advice

LitigationWatch is not a law firm and does not provide legal advice. Alerts and other content are general information only. You should obtain independent legal advice before acting, or deciding not to act, on any matter.

Your account

You sign in with one-time links or codes sent to your email address. You are responsible for keeping access to that email account secure and for all activity under your LitigationWatch account. Tell us promptly through our support page if you believe your account has been accessed without permission.

Plans, billing and cancellation

  • Paid plans are billed monthly in advance, in US dollars, through our payment processor Stripe. Your plan renews automatically each month until cancelled.
  • Each plan allows a maximum number of entities on your watchlist. If your watchlist exceeds your plan's limit, for example after a downgrade, entities beyond the limit (most recently added first) are paused until you have room.
  • Upgrades take effect immediately and are charged on a prorated basis. You can cancel at any time from the Billing page; cancellation takes effect at the end of the current billing period and monitoring continues until then.
  • Except where required by law, fees are not refundable for partial billing periods. If you delete your account, your subscription is cancelled immediately and no further charges are made.
  • We may change our prices with at least 30 days' notice by email. The new price applies from your next billing period after the notice period.
  • Corporate plans may be subject to a separate written agreement, which prevails over these terms to the extent of any inconsistency.

Acceptable use

You must use the Service lawfully and only for legitimate purposes, such as risk management, compliance, credit, investment and legal monitoring. You must not:

  • use the Service, or information from it, to harass, intimidate or unlawfully discriminate against any person;
  • use the Service in breach of any court order, privacy law or other law;
  • resell, sublicense or redistribute the Service or alerts as a commercial data product without our written agreement;
  • attempt to gain unauthorised access to the Service, interfere with its operation, or scrape or reverse engineer it; or
  • create accounts by automated means or share an account in a way intended to avoid plan limits.

Your data

You retain ownership of your watchlist and the notes you add. You grant us a licence to store and process that information only as needed to provide and improve the Service. We keep your watchlist confidential and handle personal information as set out in our Privacy Policy.

Availability and changes

We aim to keep the Service available and to run monitoring every day, but we do not guarantee uninterrupted or error-free operation. We may change or improve the Service from time to time. If we make a change that materially reduces the Service, we will tell you by email.

Liability

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our liability for failing to comply with a consumer guarantee can be limited, it is limited to supplying the services again or paying the cost of having them supplied again.

Subject to the paragraph above and to the maximum extent permitted by law:

  • we are not liable for any loss arising from a missed, late or inaccurate alert, from court information being unavailable, or from your reliance on an alert without checking the court record;
  • we are not liable for any indirect or consequential loss, or for loss of profits, revenue, data or opportunity; and
  • our total liability to you in connection with the Service is limited to the fees you paid us in the 12 months before the event giving rise to the claim.

Indemnity

You indemnify LitigationWatch and its officers, employees and contractors against all claims, demands, losses, damages, liabilities, costs and expenses (including reasonable legal costs) arising out of or in connection with:

  • the searches and monitoring you appoint us to carry out, including any claim by an entity on your watchlist, or by any other person, in relation to them;
  • your use of the Service, alerts or any information obtained through the Service, and any decision you make or action you take, or decide not to take, in reliance on them;
  • the entities, notes and other information you submit to the Service;
  • your breach of these terms; or
  • your breach of any law or of any person's rights, including privacy rights.

This indemnity does not apply to the extent that a loss is caused by our breach of these terms or by our negligent, fraudulent or wilful wrongdoing. It continues after your account is closed or these terms end.

Suspension and termination

You may stop using the Service and delete your account at any time from Settings. We may suspend or close your account if you materially breach these terms, if your payments fail and are not resolved, or if required by law. Where reasonable, we will give you notice first.

Changes to these terms

We may update these terms. If a change is material, we will notify you by email at least 30 days before it takes effect. Continuing to use the Service after that date means you accept the updated terms.

Governing law

These terms are governed by the laws in force in Australia. You and we submit to the non-exclusive jurisdiction of the courts of Australia.
